What is a war crime and could Putin be prosecuted over Ukraine?

A Russian soldier has admitted to killing an unarmed civilian in the first war crimes trial to be held in Ukraine since the conflict began. Ukraine says it has identified more than 10,000 possible war crimes, but the Russian government denies the allegations. The International Criminal Court has also sent a team of investigators and forensics experts to the country. What is a war crime? It may not seem like it, but “even war has rules”, as the International Committee of the Red Cross puts it. These are contained in treaties called the Geneva Conventions and a string of other international laws and agreements. Civilians cannot be deliberately attacked – nor can the infrastructure that is vital to their survival. Some weapons are banned because of the indiscriminate or appalling suffering they cause – such as anti-personnel landmines and chemical or biological weapons. The sick and wounded must be cared for – including injured soldiers, who have rights as prisoners of war. Serious offenses such as murder, rape, or mass persecution of a group are known as “crimes against humanity” or, in some circumstances, “genocide”. What did the Russian soldier do? The 21-year-old Russian tank commander Vadim Shishimarin admitted to shooting 62-year-old Oleksandr Shelipov in the head, a few days after the invasion began. Prosecutors said Shishimarin had been ordered to kill the unarmed civilian. He is being tried in a Kyiv district court and faces life in jail. “By this first trial, we are sending a clear signal that every perpetrator, every person who ordered or assisted in the commission of crimes in Ukraine shall not avoid responsibility,” Ukraine’s chief prosecutor Iryna Venediktova tweeted. She previously said her office was preparing cases against 41 Russian soldiers for offenses including killing civilians, rape, bombing civilian infrastructure, and looting. What other allegations of war crimes have there been in Ukraine? US President Joe Biden and UK Prime Minister Boris Johnson have both accused Russia of carrying out war crimes in Ukraine. Investigators and journalists found what appeared to be evidence of the deliberate killing of civilians in Bucha, a town on the outskirts of Kyiv, and other nearby areas. Ukrainian forces said they found mass graves and evidence that civilians had been killed after their feet and hands were bound. In March, a Russian strike on a theatre in Mariupol appeared to be the first confirmed location of a mass killing. The word “children” was written in giant letters outside the building. Ukraine previously called Russia’s airstrike on Mariupol’s hospital a war crime. Many experts argue the invasion itself is a crime under the concept of “aggressive warfare”. How can suspected war criminals be prosecuted? There have been a series of one-off courts since World War Two – including the tribunal investigating war crimes during the break-up of Yugoslavia. A body was also set up to prosecute those responsible for the 1994 Rwanda genocide. Today, the International Criminal Court (ICC) and the International Court of Justice (ICJ) both have roles upholding the rules of war. The International Court of Justice (ICJ) rules on disputes between states, but cannot prosecute individuals. Ukraine has begun a case against Russia. If the ICJ ruled against Russia, the UN Security Council (UNSC) would be responsible for enforcing that. But Russia – one of the council’s five permanent members – could veto any proposal to sanction it. The International Criminal Court (ICC) investigates and prosecutes individual war criminals who are not before the courts of individual states. It’s the permanent modern successor to Nuremberg, which prosecuted key Nazi leaders in 1945. Nuremberg cemented the principle that nations could set up special courts to uphold international law. Can the ICC prosecute offences in Ukraine? The ICC’s chief prosecutor, British lawyer Karim Khan QC, believes there is a reasonable basis to believe war crimes have been carried out in Ukraine. Investigators will look at past and present allegations – going back as far as 2013, before Russia’s annexation of Crimea from Ukraine. If there’s evidence, the prosecutor will ask ICC judges to issue arrest warrants to bring individuals to trial in The Hague. However the court doesn’t have its own police force so relies on individual states to arrest suspects – and since Russia is not a member of the court it is unlikely to extradite any suspects. Could President Putin, generals, or other leaders be prosecuted? It’s far easier to pin a war crime on the soldier who commits it, than on the leader who ordered it. Hugh Williamson of Human Rights Watch – an organization with expertise in gathering evidence of war crimes in conflicts – agrees there is evidence of summary executions and other grave abuses by Russian forces. He says establishing the “chain of command” is very important for any future trials – including whether a leader authorized an atrocity – or turned a blind eye to it. The ICC can also prosecute the offense of “waging aggressive war”. This is the crime of an unjustified invasion or conflict, beyond justifiable military action in self-defense. It originated at Nuremberg after the judge sent by Moscow convinced the Allies that Nazi leaders should face justice for “crimes against peace”. However, Professor Philippe Sands QC, an expert on international law at University College London, says the ICC couldn’t prosecute Russia’s leaders for this because the country isn’t a signatory to the court. In theory, the UN Security Council could ask the ICC to investigate this offense. But again, Russia could veto this. Study shows: Nuking an incoming asteroid could actually work

Firing a nuclear warhead at an asteroid on a collision course with the Earth could stop 99 percent of it from hitting the planet, according to a new study. Every two years the Center for Near-Earth Object Studies at the NASA Jet Propulsion Laboratory in California runs a simulation on the result of an asteroid impact. In this year’s scenario, a fictional 329ft (100m) asteroid, dubbed 2021 PDC, wasn’t detected until it was only six months from hitting the planet – not enough time to send up a spaceship to nudge it, or take any action on the planet to save many lives. However, new research by Johns Hopkins University, in Baltimore, Maryland, found that a megatonne nuke, exploding near the surface of the asteroid, would destroy it without leaving thousands of large fragments still heading for the Earth. ‘If we employ a robust nuclear disruption technique by at least one month before impact, we can prevent 99 percent or more of the impacting mass from hitting the Earth,’ study lead author Patrick King told Gizmodo. How it would work? A large one megatonne nuclear warhead would be fired from Earth to the asteroid heading for the planet. This is 50 times more powerful than Little Boy, which was dropped on Hiroshima by the US in 1945. It would be set to detonate just above the surface of the asteroid. This would send a shockwave that should rip the space rock apart, causing it to fragment into thousands of much smaller pieces. Experts tracked the likely trajectory and found if the nuke went up two months before the rock was due to hit the Earth, 99 percent of fragments would miss the planet. It is likely that the one percent that arrived should break up in the Earth’s atmosphere, causing no damage. This is an idea that has become a staple of Hollywood disaster films, most famously in the 1998 movie Armageddon, in which Bruce Willis and a crew of deep-core drillers are sent up to a giant incoming asteroid to blow it up. Unlike in Armageddon, the Johns Hopkins University team believes it would be enough to just fire the nuke at the asteroid from the ground – no need to get Willis out of retirement. This isn’t the first time NASA, or other planetary scientists, have investigated the idea of using a nuke to destroy an incoming asteroid, but the team looked at the potential path of the many resulting fragments. Previously, it was thought that even if we did succeed in blowing up a large space rock, some of the fragments would still be large enough to destroy cities and cause mass destruction. Simulated exercises in May, funded by NASA, found that even firing a nuke at a space rock six months before it hit the Earth wouldn’t bring it down. However, the team from Johns Hopkins disputes these findings, taking a much closer look at the nuclear explosion and fragments caused by it ‘going up’. To understand the true path of fragments from a destroyed asteroid, the team simulated their resulting orbit and trajectory, tracking them from the detonation of a megatonne nuke, through to their resulting orbit around the sun. The team included the impact the gravity of other planets in the inner solar system, such as Venus and Mars, might have on their trajectory and whether it could nudge them into hitting the Earth. Their simulation found that this massive bomb, 50 times more powerful than Little Boy, which destroyed Hiroshima in WW2, would do the trick if ignited near the surface of a 328ft (100m) space rock on its way to the Earth. They tested their findings at five different distances from the planet, finding it worked in all cases – so would be a viable option for last-minute arrivals. Obviously, the more in advance of the impact the nuke is fired, the better, as it further reduces the volume of incoming materials, they found. An asteroid is a large chunk of rock left over from collisions or the early solar system. Most are located between Mars and Jupiter in the Main Belt. A comet is a rock covered in ice, methane, and other compounds. Their orbits take them much further out of the solar system. A meteor is what astronomers call a flash of light in the atmosphere when debris burns up. This debris itself is known as a meteoroid. Most are so small they are vapourised in the atmosphere. If any of these meteoroids make it to Earth, it is called a meteorite. Meteors, meteoroids, and meteorites normally originate from asteroids and comets. For example, if Earth passes through the tail of a comet, much of the debris burns up in the atmosphere, forming a meteor shower. The larger the asteroid heading for the planet, the more in advance you’d need to fire the nuke in order to limit large fragments from still causing untold damage. It is still possible to have 99 percent of the resulting fragments of a large asteroid miss the Earth, but you’d need to hit it six months in advance, rather than one or two months with a smaller rock. ‘We employed several approximations in order to make the study feasible, but we believe that we have captured the essential physics necessary to make general observations about nuclear disruption as a technique,’ King told Gizmodo. ‘Much of our uncertainty is driven by our inherent uncertainty in the properties of the asteroids themselves; we definitely need to support more space missions to investigate their properties in more detail.’ It wouldn’t always be a viable option, according to King, who said there is always a possibility of many smaller pieces still hitting the Earth, causing worse problems than a large impact. ‘By making several fragments instead of one single impactor, it is possible that we multiply the threat,’ he wrote in the paper. ‘On the other hand, disruption has its own advantages, and a disruption could succeed >>Read more

A post-war surfing renaissance is underway in Africa’s oldest republic

Nestled between Ivory Coast, Sierra Leone, and Guinea, Liberia is the oldest republic in Africa. But despite its historic legacy, in the minds of many outsiders, the West African nation is still more commonly associated with civil war and convicted war criminal Charles Taylor. But at the end of the second civil war in 2003, as Liberia was on the cusp of democratically electing the continent’s first female head of state, a different narrative was emerging in the fishing village of Robertsport; one that would ultimately change the culture of this tiny seaside community on the border of Sierra Leone. “After the war in 2003, some Americans came to Robertsport, where they started surfing our waves,” recalls local surfer Philip Banini. “(They) came across a Black guy, Alfred Lomax, who was the first Liberian surfer, and they taught him the sport. And that was how he too started sharing it with the locals around here.” Lomax, now the country’s most recognized and decorated surfer, taught Banini, who in turn has taught countless others, growing the community from one into many. Today, inside Banini’s guesthouse hangs a sign that reads “When nothing is going right, surf a left” — a reference to the left break for which Robertsport is famous. The village is now one of Liberia’s three main surfing destinations, the others being the capital Monrovia, and Harper on the border with Ivory Coast. Between the palm trees and long stretches of sandy beach which hug the Atlantic Ocean, every day the water is dotted with surfers. To borrow a surfing expression, “the stoke is real.” A growing community Surfing has a long history in Africa. The earliest account, from Ghana in the 1640s, even predates the earliest record from surfing’s spiritual home of Hawaii. The parallel development and history of African surfing are less well known, and the sport remains less established than in other parts of the world. But a renaissance is underway. Today, Robertsport is a world apart from when Canadians Kent Bubbs and Landis Wyatt first set foot on its beach. Since relocating to Liberia 15 years ago, Bubbs has witnessed how the community of roughly 4,000 people has grown to include over 60 local surfers. “There are more and more surfers every year,” Bubbs tells CNN. “The kids who used to surf originally are now having kids, and those kids are surfing — it is becoming generational. We often see multiple family members out surfing together.” Among them are the former men’s national surf champion Oscar Comney and his younger brother, Massalley “Samon” Comney, whom Oscar taught how to surf. Through their NGO Universal Outreach Foundation, Bubbs and Wyatt have played an active role in helping to grow the Liberian surf community through surf tourism initiatives. They also find sponsors for the country’s only national surf competition, which they run in collaboration with Robertsport’s Surf Club. “The idea behind (the competition) was simply to give the youth and kids of Robertsport something to look forward to,” Bubbs explains. “Surfing has become a place where the young people can go and enjoy the company of their friends, compete against each other, and be in an environment where they can express themselves and work through some of the challenges of life with like-minded people.” Massalley recently won the Robertsport under 18s competition and plans to challenge his brother for the adult title in the future. One of eight children, the 17-year-old juggles working at Banini’s guest house and selling handmade bracelets to tourists to support his high school tuition. “I really love surfing because I feel like I’m the best man on planet Earth,” says the young up-and-comer. He’s also not the only one making a splash; Irene George is the only local female surfer from Robertsport and the current women’s competition champion. Her skills have earned her the nickname “Butterfly,” because she moves through the waves like she is flying. After a break from surfing to pursue studying hospitality in Monrovia, she is now back in the water and eager to prove herself. She hopes to inspire more Liberian women to take up surfing but acknowledges there are some challenges. “When (I) go around saying, ‘I want to teach you how to surf,’ they say, ‘I don’t know how to swim.’ Once you can swim you can surf, so we need to teach (people) how to swim first,” she says. It’s George’s plan to someday open a swim and surf school of her own called Liberian Future Surf School. Surf tourism Reputation and infrastructure could pave the way for Liberia to join South Africa and Morocco as key African surfing destinations. Robertsport is looking to tap into an international surfing market expected to be worth more than $4.8 billion by 2027, and riding its waves are tourists from all over the world. Despite tourism setbacks — first, from a two-year Ebola outbreak that began in 2014, followed by the Covid-19 pandemic — Banini says things are looking up. These tourists bring with them skills to share along with surfboards, wax, and dollars to contribute to the growing surf tourism economy. Some tourists donate boards to locals before flying home, while others are provided by Swiss NGO Provide the Slide, which collects old boards and ships them to countries all over West Africa. But with only one repair shop in all of Liberia, run by Bubbs, it’s not unusual to see local surfers happily sharing broken and battered boards. Bubbs recalls a time when the only visitor accommodation in Robertsport was camping on the beach, but that has changed as more guest houses have opened. Soon the Robertsport Surf Club will have its own property, which will be used to run surf lessons, and fishing trips and eventually offer accommodation too, diversifying opportunities in what is still a fishing-dependent local economy.
